West Virginia man accused of threatening to kill ICE agents, court records show

Court records say a West Virginia man is accused of making threats to attack or kill U.S. Immigration and Customs Enforcement agents.

Cody Lee Smith, 20, of Clarksburg has been charged with making threats of terroristic acts after an investigation conducted in January, according to a criminal complaint filed in Harrison County Magistrate Court.

The complaint alleges Smith posted videos of himself contacting the U.S. Department of Homeland Security and stating he was going to “attack and kill ICE agents.”

Troopers said the investigation also uncovered social media posts in which Smith described how he “intended to ‘murder’ Trump supporters and/or war supporters and/or service members willing to ‘bootlick,’” according to the complaint.

During a preliminary hearing Tuesday, Harrison County Magistrate Judge Warren Davis found probable cause to advance the case to circuit court.

Smith remains in custody on a $75,000 bail.
