According to the probable cause affidavit, police documented two narcotics transactions at the residence during the weeks of January 19 and January 26.
During the first incident, officers obtained a baggie containing 2 grams of a gray powdery substance from Palacios inside a vehicle parked in front of the home. The substance field-tested positive for heroin.
During the second incident, officers recovered a baggie containing 2.2 grams of a powdery substance from Palacios inside the residence, which also field-tested positive for heroin.
Based on these incidents, police obtained a search warrant for the home, executed on February 5. After repeated knock-and-announce attempts with no response, officers entered the residence.
Palacios was found exiting the bathroom. Officers observed a substantial amount of white powdery residue on the bathroom sink near the toilet that field-tested positive for cocaine. The condition of the sink and toilet suggested the suspected cocaine residue was being flushed.
In the living room, police found a digital scale with white powder residue, a baggie containing 11 grams of marijuana, and Palacios’ ID on the same table. Officers also located 0.7 grams of cocaine on the table.
In the kitchen, they discovered a large vacuum-sealed bag containing 517.7 grams of marijuana.
During an interview after being advised of his rights, Palacios admitted to past involvement in narcotics sales in Ohio and said he sells drugs to pay his bills.
